Illinois Just Got Its First Statewide Building Code

This is a real, recent, and genuinely newsworthy change, not background trivia. Illinois historically had no statewide building code at all — local governments could choose whether to adopt one, and many small towns and rural unincorporated areas had none. A homeowner or builder in one of those areas could construct a deck, shed, or garage with no plan review, no inspection, and no minimum construction standard.

Public Act 103-0510 changed that. Effective January 1, 2025, every area in Illinois — regardless of whether it previously had a code — must meet a minimum standard tied to the International Code Council: the 2018, 2021, or 2024 edition of the International Building Code, International Existing Building Code, and International Residential Code. Municipalities and counties had to confirm compliance to the Illinois Capital Development Board by June 1, 2025.

Cities and counties still retain the right to adopt their own, stricter codes and permit requirements — Chicago has long run its own comprehensive code, for example — but the new law closes the real gap that used to leave some Illinois construction genuinely unregulated.
